1. Agreement to these Terms

These Terms of Service ("Terms") form a binding contract between you and [LEGAL ENTITY] ("Formward", "we", "us", or "our"), a company registered in Sweden with its registered office at [ADDRESS]. They govern your access to and use of the Formward form-backend service available at formward.eu (the "Service").

By creating an account, accessing, or using the Service, you accept these Terms in full. If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation, and "you" includes that organisation. If you do not agree to these Terms, do not use the Service.

2. The Service

Formward is a form-backend service. It provides an HTTP endpoint to which you can point the action attribute of an HTML <form> element on your website. When a visitor submits that form, Formward:

  • receives, validates, and stores the submission;
  • applies spam-detection measures (honeypot, rate limiting, origin allowlists, optional Cloudflare Turnstile) and, on paid plans, AI spam scoring and enrichment;
  • sends a notification email to the address you have configured as the form owner;
  • makes the submission available in your dashboard where you can view, search, and export it.

Features available to you depend on your plan as described on the plans page. We may modify, suspend, or discontinue any feature with reasonable notice.

3. Privacy

Our handling of personal data is described in our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Service you acknowledge that we process personal data as described there, including the storage of all submission data within the European Union.

4. Electronic communications

By using the Service you consent to receive communications from us electronically (including service notices, transactional emails, billing receipts, and security alerts) sent to the email address associated with your account. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

5. Your account

You must provide accurate information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at security@formward.eu if you suspect unauthorised access. We are not liable for losses arising from your failure to safeguard your credentials.

You may not transfer or assign your account to another person without our prior written consent.

The Service is not directed at children. You must be at least 16 years old to create an account. If you are under 16, you may only use the Service with the consent and supervision of a parent or legal guardian, consistent with GDPR Article 8 and applicable EU member state law.

6. Acceptable use

You may only use the Service for lawful purposes and in accordance with these Terms. You agree not to use the Service to:

  • collect, process, store, or transmit any content that is unlawful under applicable law, including content that is defamatory, obscene, fraudulent, or that infringes any third party's rights;
  • configure a notification address that you do not own or are not authorised to receive email on behalf of;
  • use the Service to send unsolicited, bulk, or commercial email (spam), newsletters, or marketing campaigns. Formward's email delivery is for transactional submission notifications only and must not be used as a mass-mailing relay;
  • send phishing, malware, or otherwise malicious or deceptive content through the Service;
  • scrape, crawl, or otherwise extract data from the Service by automated means, or submit forms at a rate designed to abuse the Service or circumvent rate limits or spam filters;
  • interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorised access to any part of it, another user's account, or connected systems;
  • use the Service in violation of applicable export-control or economic sanctions laws, including those of the European Union and its member states. You represent that you are not located in, and will not use the Service on behalf of any person in, a sanctioned territory or on a relevant restricted-party list;
  • collect or process special-category personal data (GDPR Art. 9) without implementing the safeguards required by applicable law.

We may suspend or terminate your account immediately if we reasonably believe you are violating this section.

7. Intellectual property

The Service, including its software, design, documentation, and the "Formward" name and marks, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

Your data remains yours. We claim no ownership of the form submissions, account information, or other content you or your end-users provide. You grant us only the limited licence necessary to host, process, transmit, and display that content for the purpose of providing the Service to you.

8. Customer data and data-protection roles

Under the GDPR, the parties' roles differ depending on the category of data:

  • Submission data (your end-users' data): You are the controller of the personal data contained in form submissions made by your website visitors. Formward acts as a processor that handles that data on your documented instructions and solely to provide the Service.
  • Account data: Formward is the controller of the account data we collect to operate the Service and our business (e.g., your account email, billing records, and security logs), as described in the Privacy Policy.

Where Formward acts as your processor, the processing is governed by a Data Processing Agreement (DPA), which is available on request from privacy@formward.eu and which forms part of these Terms when executed. The DPA reflects that all submission data is stored in Sweden and processed within the EU/EEA, with no transfers outside the EU/EEA.

9. Confidentiality

Each party may receive non-public information from the other in connection with the Service ("Confidential Information"). Each party agrees to protect the other's Confidential Information with reasonable care, to use it only as necessary to perform under these Terms, and not to disclose it except to personnel or sub-processors bound by confidentiality obligations, or where disclosure is required by law. This obligation does not apply to information that is or becomes public through no fault of the receiving party.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Formward and its officers and employees from any third-party claims, damages, and reasonable costs arising out of: (a) your use of the Service in breach of these Terms; (b) the content of the submissions you collect; or (c) your failure to meet your obligations as a controller of your end-users' data. This section does not apply to the extent a claim arises from our own breach, negligence, or unlawful conduct, and does not affect any mandatory rights you have as a consumer.

11. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not offer a formal service-level agreement (SLA) on standard plans; planned maintenance is communicated through our status page.

Nothing in this section limits warranties or guarantees that cannot be excluded under mandatory law, including the statutory rights of consumers resident in the EU.

12. Limitation of liability

To the maximum extent permitted by applicable law, Formward's total aggregate liability for all claims arising under or related to these Terms or the Service shall not exceed the total fees you paid to Formward in the three (3) months preceding the event giving rise to the claim.

To the maximum extent permitted by applicable law, Formward shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, for death or personal injury caused by negligence, or the non-excludable statutory rights of EU consumers. If you are an EU consumer, these limitations apply only to the extent permitted by the mandatory consumer-protection law of your country of residence.

13. Plans, billing, and taxes

13.1 Plans

Formward offers a Free plan, paid Personal, Professional, and Business plans, and a Custom plan. Plan features and limits are described on the plans page and may be updated from time to time.

13.2 Billing

Paid subscriptions are billed in advance through Stripe on a monthly or yearly basis, depending on the billing period you select. By subscribing you authorise Stripe to charge your payment method on a recurring basis. Prices are displayed exclusive of VAT; EU VAT is calculated and collected via Stripe Tax in accordance with applicable EU VAT rules.

13.3 Upgrades, downgrades, and renewal

Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. Upgrades take effect immediately, with charges prorated where applicable. Downgrades and cancellations take effect at the end of the current paid period, and you retain access to your plan's features until then.

13.4 Right of withdrawal and refunds

If you are a consumer resident in the EU, you have a statutory 14-day right of withdrawal for distance contracts. Where this right applies and you have not waived it by requesting immediate performance and acknowledging the loss of the withdrawal right, you may withdraw within 14 days of subscribing for a refund of the fees paid for that period.

Outside the statutory withdrawal right, fees already paid are non-refundable for the remainder of the current term, and your access continues until the end of that term. Business customers (non-consumers) are not entitled to the consumer withdrawal right.

13.5 Price changes

We may change plan prices with at least 30 days' notice. If you do not agree to a price change, you may cancel before the new price takes effect.

14. Chargebacks

We operate a zero-tolerance policy on unwarranted chargebacks. If you dispute a charge, please contact team@formward.eu first so we can resolve it. Initiating a chargeback without first attempting resolution may result in immediate suspension of your account pending investigation. This does not affect your statutory rights, including any right of withdrawal or refund described above.

15. Publicity

We may identify you as a Formward customer, including by displaying your name or logo on our website and in marketing materials. If you prefer that we do not, simply let us know at team@formward.eu and we will refrain from doing so. We will always honour a request to remove such references.

16. Termination

You may delete your account at any time through the account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your access with reasonable notice where practicable. In cases of serious or repeated violation of these Terms (including the Acceptable Use section), or where required by law, we may terminate immediately without notice.

Sections that by their nature should survive termination, including Intellectual property, Customer data and roles, Confidentiality, Indemnification, Disclaimer of warranties, Limitation of liability, and Governing law, survive termination.

17. Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles and without prejudice to the mandatory consumer-protection law of your country of residence. Subject to the following paragraph, the courts of Stockholm, Sweden shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

If you are a consumer resident in the EU, you retain the protection of the mandatory provisions of the law of your country of residence and may bring proceedings in your local courts where applicable consumer law so provides. You may also refer disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you by email with at least 14 days' notice before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and cancel your subscription before the effective date.
